Kitatta’s Lawyer asks Army court to set him free
The Lawyer representing Boda Boda 2010 Patron Abdullah Kitatta, Shaban Sanywa, has asked the Army Court in Makindye to set free his client because Prosecution led by Major Rapheal Mugisha, has failed to prove the case against him.
Kitatta and 12 others are facing five counts related to unlawful possession of firearms, ammunitions and Military attires. Now his Lawyers say Prosecution failed to produce the investigating officer and the officer who allegedly recovered these guns on Kitatta, to testify and guide Court on what happened at the scene of crime-Vine Hotel in Wakaliga where Kitatta was picked.
No forensic examinations was also done to establish if Kitatta fired the golden pistol which Prosecution brought as an exbhit, or how the exbhits were recovered, moved and stored.
No independent witness such as the Manager and Workers from Vine Hotel or any expert witness was produced in the Court to confirm whether the firearms, ammunitions, uninforms presented to Court as exbhits had the DNA of Kitatta.
Sanywa therefore submitted to the Seven Member Panel Chaired by Lt. Gen Andrew Gutti, that failure by Prosecution to bring these witnesses shows that the accused has not been placed at the scene of crime and the charges against him were merely cooked up to keep way Kitatta from Society.
Kitatta is has been further remanded untill 10th/December when Prosecution will respond to the submissions of Kitatta’s Lawyers.
There after the Army court will make a decision on whether Kitatta has a case to answer, which will either lead to his defence case or acquittal.
