Court Order: Auctioning of Kabagarame pork market land recalled.
Western Uganda – Mbarara High Court has recalled its August 26,2019 order sanctioning the auctioning of the land where Kabagarame pork market is situated in Bushenyi-Ishaka municipality,following pressure from Bushenyi District leaders,residents and other many people.
Mr Lauben Tayebwa of Best Associated Auctioneers and Court Bailiffs, Mbarara High Court Deputy Registrar Amos Kwizera have recalled the earlier directive following complaints from lawyers of Ishaka-Bushenyi Municipality.
“I wish to recaII with immediate effect the (2) own warrants issued to you in respect of the above-mentioned matter for attachment and sale, and to give vacant possession immediately,” the court directive reads in part.
“This recall has been prompted by a complaint (as attached) lodged by counsel for the defendant/ appellant which complaint shall be addressed In presence of both parties and their advocates on 2nd September 2019 at 9:00 am when the matter is scheduled for mentIon before the Deputy Registrar,” he added.
Mbarara High Court Deputy Registrar Mr Amos Kwizera had directed Best Associated Auctioneers and Court Bailiffs to sell the land within 30 days,which sparked #SaveKabagarame march.
Businessman Manfred Muhumuza and others who won a park land case claim they demand Shs1.6 billion, but municipal authorities say they know 187 million.
Both parties will now sit and harmonize on payment following intervention of finance ministry, attorney general,area Members of parliament,and others.
It should be learnt that Speaker of Parliament Rt Hon Rebecca Kadaga also ordered finance minister and attorney general to intervene.
